Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and megaphone LLC, operating as PYNK.studio ("we", "us", "our"). They govern your access to our website and your purchase and use of our creative services. By placing an order or using the site, you agree to these Terms. If you do not agree, do not use the service.
1. What we do
We are an AI-powered creative studio. We produce marketing deliverables (creator-style UGC videos, static ad creatives, and product visuals) generated from the brand and product information you provide. Our creators, scenes, and voices are AI-generated; they do not depict real, identifiable people and are not intended to be the likeness of any specific individual.
Because each deliverable is custom-generated for your order, the exact output will vary. We describe on each service page what is included; anything outside that description is not part of the order.
2. Your inputs and your responsibilities
To fulfill an order you give us inputs, such as brand details, a product link or photo, and similar materials. You represent and warrant that you own or have the rights to those inputs and that our use of them to create your deliverables will not infringe anyone's rights or violate any law.
You are responsible for how you use the deliverables, including any advertising, health, or performance claims you make with them, and for ensuring your use complies with applicable laws and the policies of the platforms you run them on (for example, Meta, TikTok, and Google).
Our creators are synthetic. Where the law or a platform requires you to disclose that content is artificially generated or manipulated, meeting that obligation is yours, not ours. Disclosure duties of this kind attach to the party publishing the content, and that is you. This includes the transparency obligations under the EU AI Act for anyone deploying artificially generated or manipulated image, audio, or video content.
You must not present a creator, voice, or scene we produce as a real customer, reviewer, tester, or endorser of your product, or attribute an experience or opinion to them as though it were a real person's. Nothing we deliver is a genuine testimonial, and presenting it as one is deceptive advertising in most markets we sell into, regardless of any disclosure you add elsewhere.
- Do not submit content that is illegal, infringing, defamatory, or that you lack the rights to.
- Do not use the service for regulated, deceptive, adult, hateful, or dangerous categories, or to impersonate a real person.
- Do not pass off a synthetic creator as a real customer, reviewer, or endorser.
- Do not attempt to disrupt, reverse-engineer, or abuse the service or its rate limits.
3. Ownership and license
When your order is paid and delivered, you receive a worldwide, perpetual, non-exclusive, royalty-free license to use, reproduce, modify, and display the delivered files for any lawful commercial or personal purpose, including paid advertising, with no separate creator fees, usage-rights fees, or whitelisting charges.
We retain all rights in our own technology, prompts, templates, models, and pipeline. Nothing here transfers ownership of those to you. You keep ownership of the original inputs you supply.
AI-generated outputs may not be eligible for copyright protection in every jurisdiction. We do not warrant that any deliverable is exclusive to you or independently protectable, and similar outputs may be produced for others.
4. Prices, payment, and tax
Prices are shown in U.S. dollars and are exclusive of tax. Applicable sales tax or VAT is calculated and added at checkout based on your location, and payment is processed securely by Stripe. We do not see or store your full card details.
You authorize us (through Stripe) to charge the total shown at checkout. Orders are only fulfilled after payment succeeds.
5. Delivery and refunds
We aim to deliver most orders within minutes, but turnaround times are estimates, not guarantees. If something we deliver is wrong, contact us and we will work with you to put it right. Refund eligibility, automatic refunds for failed orders, and partial refunds for multi-item orders are described in our Refund Policy, which is part of these Terms.
Work on your order starts as soon as your payment settles. At checkout you ask us to begin immediately and confirm that you understand this means giving up the 14-day right of withdrawal that would otherwise apply to an online purchase of digital content, and we confirm that back to you in your order confirmation email. Your statutory rights where a deliverable is faulty or not as described are unaffected. The Refund Policy sets all of this out in full.
6. No performance guarantee; deliverables provided “as is”
We do not guarantee any particular business result, such as sales, engagement, or ad performance. AI systems can produce inaccurate, unexpected, or imperfect output. You are responsible for reviewing each deliverable before you publish or run it.
To the fullest extent permitted by law, and subject to the paragraph below, the service and all deliverables are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.
This section does not exclude or limit anything that cannot lawfully be excluded or limited. If you buy as a consumer, you have statutory rights, including rights to a remedy where a deliverable is faulty or does not match how we described it, and nothing here removes them. Where a mandatory consumer-protection law applies to you, that law wins over this section.
7. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the service or a deliverable is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data.
8. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your inputs, your use of the deliverables, or your breach of these Terms.
9. Changes and termination
We may update these Terms from time to time; material changes take effect when posted with a new “last updated” date. We may suspend or decline service for any order that violates these Terms.
10. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located there for any dispute not otherwise resolved.
